We also touched on the issue of data breaches, particularly how data can be vulnerable when stored on the cloud, as well as the legal remedies and recourses available.

Imaduddin Suhaimi and Brian Lew address the Kuala Lumpur Bar Committee on the inception of the Anti-Fake News Act 2018, its salient features, what is fake news, offences under section 4 of the Act, the extraterritorial effect of the Act, penalties and defences, the related offences under the Printing Press and Publications Act 1984 and the Communications and Multimedia Act 1998, the judicial attitudes and an explanation of the tort of defamation as well as provisions under the Evidence Act 1950 and the liability of directors and employers.

Bank Negara Malaysia (Anti-Fake News Act 2018)

Imaduddin Suhaimi and Brian Lew deliver a Continuing Professional Development session to the staff of Bank Negara Malaysia (BNM). The session centred on the role of the Anti-Fake News Act 2018 in the social media age, the construction of the Act from a legal perspective, other legal bases under legislation and the common law for fake news liability, the related concepts of defamation and offences under both the Printing Press and Publications Act 1984 and the Communications and Multimedia Act 1998, the evidentiary burdens, as well as best practices for organisations such as BNM to put in place to control the spread of fake news.
